## Scope

These terms govern the use of the CampingSpirit website and web app (the "service") operated by Camping Spirit, Kanton Zürich, Schweiz. By using the service or creating an account you accept these terms. Deviating terms of users do not apply.

## The service

CampingSpirit helps you plan road trips and camping holidays: routes, places to stay, weather, checklists, travel diary and community content. Parts of the service are currently offered as a demonstration; features, content and scope may change.

## A planning aid, not a guarantee

All information — in particular routes, travel times, road rules, tolls and vignettes, low-emission zones, pass and road openings, ferry times, weather, campsite details, prices and opening times — is provided without guarantee and may be incomplete, wrong or out of date. Some content comes from users or third parties. Always check official sources (e.g. road authorities, campsite operators, weather services) before and during your trip.

## Driving responsibly and vehicle restrictions

You alone are responsible for your vehicle and your driving. Observe traffic rules, road signs and instructions from the authorities, which always take precedence over the app. Check restrictions on height, width, length, weight, trailers and caravans, as well as winter equipment requirements, yourself; the app may not take all of them into account. Do not operate the app while driving — set it up before departure or let a passenger use it.

## Account

Some features require an account. You must provide accurate information, keep your password confidential and inform us immediately of any misuse. Accounts are personal and not transferable. You must be at least 16 years old. We may suspend or delete accounts in the event of serious or repeated breaches of these terms.

## Membership plans and trial

In addition to the free plan (Free) we offer paid plans (Explorer, Voyager, Nomad), whose features are described in the app. Paid plans can be tried free of charge for 7 days, once per person. If you do not cancel before the trial ends, it converts into a paid membership at the price shown at checkout. The checkout is currently a demonstration: no payment is taken and no paid contract is concluded.

## Prices, payment and cancellation

Prices, currency and billing period (monthly or yearly) are shown before you order; prices include VAT where applicable. Payment is made in advance for each billing period via our payment provider. Memberships renew automatically and can be cancelled at any time in your account settings or by email to campingspiritcom@gmail.com, effective at the end of the current billing period. Amounts already paid for the current period are not refunded unless required by law. We may change prices for future billing periods; we will inform you in advance, and you may cancel before the change takes effect.

## Right of withdrawal for EU consumers

If you are a consumer resident in the EU, you have a statutory right to withdraw from a paid contract within 14 days without giving reasons. The right of withdrawal expires early if you expressly agree that we begin providing the digital service before the withdrawal period ends and acknowledge that you thereby lose this right. Details and a model withdrawal form are provided at checkout. Swiss law does not provide a general right of withdrawal for online contracts.

## Bookings with third parties

When you book a campsite, pitch or other offer via CampingSpirit, the contract is concluded directly between you and the respective provider unless expressly stated otherwise. The provider's terms apply, and the provider is responsible for performance, cancellation and refunds. We act only as an intermediary and are not a party to that contract.

## Your content and licence

You retain the rights to the reports, reviews, photos and posts you publish. You grant us a non-exclusive, royalty-free, worldwide licence, for the duration of publication, to store, display, technically adapt (e.g. resize or crop) and make your content available within the service and in its presentation. You confirm that you hold the necessary rights, including the consent of any persons shown. The licence ends when you delete the content, subject to short-lived backup copies.

## Rules for content

Content must comply with the law and our community guidelines. In particular, false or misleading information, insults, discrimination, advertising, spam, infringements of third-party rights and the publication of other people's personal data are prohibited. We may review content, edit it for formal reasons, hide or remove it, and exclude users who break these rules.

## Availability and changes

We aim for high availability but cannot guarantee uninterrupted operation. Maintenance, technical faults or third-party services (e.g. maps, weather, routing) may cause interruptions. We may develop, change or discontinue features; if a paid feature is substantially reduced, you may cancel with immediate effect and receive a pro-rata refund.

## Intellectual property

The service, its software, design and editorial content are protected by copyright and other rights. You may use them only for personal, non-commercial purposes. Automated extraction (scraping) and reuse of the database require our written consent. Map data © OpenStreetMap contributors and other sources as indicated. Campsite and motorhome stopover data comes from OpenStreetMap and remains available under the Open Database License (ODbL 1.0); the restrictions above do not apply to it.

## Liability

To the extent permitted by law, we exclude liability for slight negligence, for indirect and consequential loss and loss of profit, and for damage resulting from incorrect or out-of-date information, third-party services or user content. Liability for intent and gross negligence, for personal injury and under mandatory statutory provisions (e.g. product liability) remains unaffected. Where mandatory consumer protection law of your country of residence provides otherwise, it prevails.

## Termination

You can delete your account at any time in the settings. We may terminate free accounts with 30 days' notice, and any account without notice for good cause, in particular for serious breaches of these terms.

## Applicable law and jurisdiction

These terms are governed by Swiss law, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the operator's registered office. If you are a consumer, you may also bring proceedings at your place of residence, and the mandatory consumer protection provisions of your country of residence remain applicable.

## Final provisions

We may amend these terms for good reason. We will notify registered users of material changes in advance; if you do not object before they take effect, they are deemed accepted — we will point this out in the notice. If any provision is invalid, the remaining provisions remain in force.
